ASSUMPTION OF RISK, WAIVER AND RELEASE AGREEMENT

To use the property, facilities, and services of Piedmont eBikes (eBikes) located at 6275 Shallowford Rd. Lewisville, NC. I agree for myself and (if applicable) for the members of my family, to the following:

Voluntary Participation

By submitting this request, I agree to test ride an electric bicycle from Piedmont eBikes. Although North Carolina law does not require a bicycle helmet when riding an electric bicycle, Piedmont eBikes requires wearing a helmet at all times during any demo rides. I confirm that I am 18 years of age or older, will wear a helmet, and will obey all local bike laws.

Assumption of Risk

Riding this electric bike and participating in bicycling exposes me to many hazards and involves unavoidable risks, including death, personal injury (such as severe spinal or head injury), and loss of or damage to property. I also understand that good physical health is necessary to participate safely. Despite these risks, I choose to participate and assume all responsibility for any injury, loss of life, or property damage arising from riding this bicycle.

Conduct of Rider

While riding the eBike, I agree to comply with all traffic laws and exercise care to ensure the safe operation of the bicycle. Stunts or any “trick” riding during the test ride are strictly prohibited.

eBike Return

The Rider agrees to return the eBike to Piedmont eBikes in the same condition as received, except for ordinary wear and tear, at the time and location specified by Piedmont eBikes.

Damage to eBike

Furthermore, the Rider shall pay Piedmont eBikes for all losses and/or damage to the eBike, regardless of fault (e.g., the Rider is responsible even if someone else caused the damage). In addition, the Rider is responsible for all theft or vandalism losses, even if they were not at fault for enabling such incidents. Should the eBike be damaged, the Rider agrees to cover the reasonable costs of repair or the retail fair market value, less any salvage value if applicable.

Release/Indemnification

In consideration for being permitted by Piedmont eBikes to ride an electric bike, I agree to indemnify, hold harmless, and defend Piedmont eBikes against any and all claims to which this agreement applies, including claims arising from their own negligence. Moreover, this indemnification extends to any loss or personal injury to third parties resulting from my use of Piedmont eBikes demo eBikes.
